Certified Copy of Will for Reg of Deeds Pictou

I Duncan McLellan of Carriboo in the County of Pictou, and Province of Nova Scotia, Farmer, make and publish this my Last Will and Testament.

First. I desire and request my two sons John McLellan and Hugh McLellan to work and cooperate together with the rest of the family until all my lawful debt is paid and the farm in Carriboo also paid for.

Secondly – When all my lawful debt is paid by their united efforts then my real estate and personal estate be divided as follows, that is to say –

Thirdly - I give and bequeath to my son John McLellan the farm in Carriboo on which the family now resides subject to the conditions hereinafter mentioned

Fourthly - I give and bequeath to my son Hugh McLellan my farm on Carriboo I also subject also to the conditions hereinafter mentioned.

Fifthly - I give and bequeath to my beloved wife Catherine McLellan half of the dwelling house in Carriboo including cellar and attic and in the body of the house and I hereby bind John McLellan my son to provide yearly and every year during her life time for his mother two barrels of flour, one barrel of oatmeal, twenty bushels of potatoes and to keep one cow as six sheep Summer and winter the increase of said cow and sheep to belong to my said wife for her own use and benefit. Also to provide a sufficient quantity of fuel cut and stored in a convenient place for her use and benefit summer and winter. Also to provide for her three pounds of teas ad Six pounds of Sugar yearly and every year and one pair of Boots yearly. Also allow her a small piece of ground for a garden if she chooses to occupy it.

I hereby also bind Hugh McLellan my son to provide and furnish his mother yearly and every year one barrel of flour one hundred pounds of oatmeal six pounds of Tea and Twelve pounds of sugar.

Sixthly – I bequeath and give my said wife all the household furniture beds and bedding, stoves and cooking utensils of every description.

Seventhly - I give and bequeath to my daughter Christy McLellan one dollar.

Eighthly - I give and bequeath to my daughter Isabelle McLellan one dollar.

Ninthly - I give and bequeath to my daughter Issy Anne McLellan one dollar.

Tenthly - I give and bequeath to my daughter Mary Jane McLellan one dollar.

Eleventhly - I give and bequeath to my daughter Willena C. McLellan twenty dollars and a house on my farm in Carriboo should she require such.

Twelfthly - I give and bequeath to my daughter Margaret J. McLellan one cow if she desires such also a house on my farm in Carriboo should she require such.

Thirteenthly - I give and bequeath to my daughter Sarah McLellan one cow if she desires such also a house on my said farm in Carriboo should she require such.

Fourteenthly - I give and bequeath to my granddaughter Catherine J. Tucker one cow if she desires such and a house like the (word scratched out and initialed) other girls and I hereby request my son John McLellan to provide and pay the above bequests to his sisters as above mentioned.

Fifteenthly - I give and bequeath to my wife aforesaid a certain lot of land on McLellan’s Mountain containing one hundred acres more or less proceeds for her own use and benefit.

I hereby appoint John McLellan my son and John Morrison of Pictou Mason to be executors of this my Will.

Signed Sealed and declared as his last Will by the said Duncan McLellan in the presence of us, who in his presence and in the presence of each other, and at his request have hereunto subscribed our names as witnesses.

I John D. McLeod Registrar of said Court do hereby certify that the foregoing paper writing is a true copy of the last Will and Testament of Duncan McLellan late of Carriboo in the County of Pictou deceased which said will was duly admitted to Probate in said Court at Pictou on the 10th. day of August 1901.

Witness my hand at Pictou this 13th. day of August 1911.
