Copy of Will for the Registrar of Deeds

I, John Weir of Stellarton in the County of Pictou and Province of Nova Scotia, Farmer, being of sound disposing mind and memory do make and publish this my last Will and Testament hereby revoking all former wills by me at any time heretofore made. I give devise and bequeath my estate and property real personal and mixed as follows, that is to say,

I give devise and bequeath to my daughter Mary Elizabeth Weir, and her heirs and assigns my dwelling house at said Stellarton with a lot of land surrounding the same, bounded and described as follows, Beginning on western boundary of Main road leading from Stellarton to Hopewell at the Southern line of George McIntosh's lands. Thence to run westerly along said line of George McIntosh's lands, one hundred and Sixty four feet, Thence Southerly one hundred and ten feet, Thence Easterly ninety feet to boundary of said Main road, Thence northerly along the boundary of said Main road One hundred and Eighty feet to the place of beginning, subject nevertheless to the following conditions, that is to say, my beloved wife Elizabeth Weir shall have the right, liberty, and privilege during the term of her natural life to use occupy possess and enjoy the parlor and bedroom adjoining in my said dwelling house from all an every manner of claim and charge therefore by any person or persons whomever.

To Have and To Hold the same to my said daughter Mary Elizabeth Weir, and her heirs and assigns forever, subject nevertheless to the right of my said beloved wife Elizabeth Weir, to use occupy possess and enjoy said parlor and bedroom adjoining for the term of her natural life.

The residue of my real estate at said Stellarton bounded and described as follows, northerly by lands of James Cameron, George McIntosh, and the said described lot hereinbefore given devised and bequeathed to my said daughter Mary Elizabeth Weir, Westerly by lands of John McIntosh and lands of Alexr. Culton, and easterly by main road leading from Stellarton to Hopewell, containing fifty acres more or less. I give devise and bequeath as follows, that is to say, said lands shall be divided equally as to quantity from front to rear, and the Southern half I give devise and bequeath to my son John William and his heirs and assigns together with the right and privilege of using the barn on the northern half in common with my son George Edward and his heirs and assigns, To Have and To Hold the same to him my said son John William Weir and his heirs and assigns forever.

The Northern half of my said farm I give devise and bequeath to my son George Edward Weir, his Heirs and assigns forever. To Have and To Hold the same to him and his Heirs and assigns together with the barn thereon, said barn to be jointly used and occupied by my said sons.

All the residue of my estate, real personal and mixed of which I shall die seized and possessed, I give devise and bequeath to my beloved wife Elizabeth Weir, and her heirs and assigns forever, together with the privilege of using the parlor and bedroom adjoining in my said dwelling house for the term of her natural life.

It is my will that my said wife and children shall not at any time sell or dispose of the property aforesaid to any person or persons unless it be to each other.

And lastly, I do nominate and appoint my said beloved wife Elizabeth Weir and my nephew William Weir, of Thorburn in the said County of Pictou, Executors of this my last Will and testament.

In testimony whereof I the said John Weir have to this my last Will and testament Subscribed my name and affixed my Seal this twenty eighth day of January in the year of our Lord one thousand Eight hundred and ninety five.

I do hereby certify that the foregoing instrument is an exact and literal copy of the last Will and Testament of John Weir late of Stellarton, in the County of Pictou, Farmer, deceased, Testate, which has been duly filed and admitted to Probate in accordance with the practice of the Court.
