Estate of Charles McKinnon late of Bailey’s Brook, Farmer, deceased, Testate

Copy of Will for the Registrar of Deeds

This is the last Will and Testament of me Charles McKinnon of Bailey’s Brook, Pictou County, Farmer.

I ordain as soon after my death as may be convenient all my just debts shall be paid by my beloved sons Donald and Lauchlin out of the proceeds of the personal property hereby bequeathed.

I will and ordain that as soon as can be following my death the sum of twenty Dollars shall be devoted towards celebrating masses for the repose of my Soul.

I desire that my beloved wife Ann and my daughter Mary shall receive during the life time of my wife one third of the income of my real and personal estate for their mutual use and benefit.

I ordain that after the death of my wife two cows or a number of sheep not to exceed six sheep shall be wintered and pastured at the expense and by my sons Donald and Lauchlin for my daughter Mary during her unmarried life instead of receiving the aforesaid income.

I ordain that should my daughter Mary at any time elect to leave the homestead in that case I ordain that the two cows and sheep be delivered to her for her own absolute use and by my sons Donald and Lauchlin in lieu of being supported by them.

I further ordain that Mary shall continue to render to my sons Donald and Lauchlin such assistance in work as become her station and ability to do so, as long as she chooses to be with them.

I order that my son John Hugh shall for a reasonable period enjoy the privileges of free board and bed in my dwelling house- with my son Donald and Lauchlin until such time as he provides a dwelling house for himself and that during the building or construction of his house, I desire that my sons Donald and Lauchlin shall assist him in accordance with their means to do so, but if my son John Hugh shall neglect to provide for himself a dwelling house within a reasonable time, it shall be incumbent on my sons Donald and Lauchlin to provide him with board and bed without he on his part performing such labor on the farm as will provide for his maintenance.

To my beloved son Alexander I give a life interest in my homestead farm and dwelling house for his decent support and maintenance at the expenses cost and care of my sons Donald and Lauchlin provided he Alexander shall continue to assist and work on the farm, and he subject to the reasonable commands of my said sons Donald and Lauchlin.

To my said sons Donald and Lauchlin I give and bequeath my homestead farm and all other real and personal property of whatever kind and wheresoever situate that I own or may die seized or possessed of, to have and to hold the same share and share alike for their mutual and absolute use and benefit, forever, subject to the foregoing orders and conditions.

It is my desire that my dwelling house shall be mutually occupied by my wife and daughter Mary until such time as my said son Lauchlin shall proved himself with a new dwelling house and during the building of said House, I desire that my son Donald shall contribute reasonable assistance towards its construction.

I hereby nominate the Reverend Colin F. McKinnon Parish Priest, Georgeville, Antigonish County Sole Executor of this my last Will and testament.

In witness whereof I the said Charles McKinnon have hereunto Subscribed my hand and acknowledging and declaring this to be m last Will and Testament this Fourth day of June in the year of our Lord One Thousand Eight hundred and eighty nine.

I do hereby certify that the foregoing instrument consisting of three pages, is an exact and literal copy of the last Will and Testament of Charles McKinnon, late of Bailey’s Brook in the County of Pictou, Farmer, deceased, Testate, which has been duly filed and admitted to Probate in accordance with the practice of the Court.
