Copy of Will for the Registrar of Deeds

I, Charles McKenzie of New Glasgow in the County of Pictou and Province of Nova Scotia, Hotel Keeper, being infirm of body but of good and perfect mind and memory and knowing the uncertainty of time, do make and declare this my last Will and Testament.

1St. First and principally I commit my Soul to God who gave it, and my body to the earth to be buried with a decent Christian burial, believing the same shall rise again at the general judgement.

2. To my wife Christy McKenzie, I give devise and bequeath all my personal property, to be used for her support and for the education of my children by my said wife, and for their support until each of them attains the age of twenty one years.

3. To my said Children I give devise and bequeath all my real Estate (subject to the encumbrances thereon) to have and to hold the same to them, share and share alike to each, at the decease or on her marriage, my said wife however to receive the rents, issues and profits of the said real estate during her lifetimes while she remains unmarried, for her own support and for the education and for the education and support of my children as in the last preceding paragraph mentioned.

4. Notwithstanding anything hereinbefore to the contrary to the contrary appearing if my executors shall deem it expedient at any time in the interest of my family or estate, to sell my real Estate for want of satisfactory returns therefrom or for any other reason rendering it expedient in the opinion of my executors so to do, my said executors are hereby authorized and empowered to sell the whole or any part of such real estate in the way they see fit, and to execute a valid conveyance of the same. The proceeds of any such Sale, after the payment of the encumbrances and charges against the property shall be invested by my said executors and the income therefrom paid to my wife, aforesaid during her lifetime while she remains unmarried, for her support and the education & support of my children, as hereinbefore mentioned, at my said wife’s decease or on the property of my said children, Share and Share alike to each.

5. I hereby appoint my said wife Christy McKenzie, Executrix, and I. Frederick MacDonald of New Glasgow, and John McDougald of Westville, Executors of this my last Will and Testament.
In witness whereof the said Charles McKenzie hath hereunto his hand and Seal Subscribed ad Set at New Glasgow aforesaid this first day of July One thousand eight hundred and eighty nine.

The aforesaid Charles McKenzie at said New Glasgow on the said first day of July One thousand eight hundred and eighty nine Signed and Sealed this instrument as and for his last Will and testament, and we at his request and in his presence and in the presence of each other and have hereunto written our names as Subscribing witnesses.

I do hereby certify that the foregoing instrument consisting of two pages, is an exact and literal copy of the last Will and Testament of Charles McKenzie, late of New Glasgow, Hotel Keeper, deceased, Testate, which has been duly filed and admitted to Probate in accordance with the practice of the Court.

Given under my hand at Pictou this 31st. day of October A.D. 1889.
