Estate of Janet Webster late of Pictou, Widow deceased, Testate

Copy of Will for the Registrar of Deeds

This is the last Will and Testament of me Janet Webster of Pictou, in the County of Pictou, Widow.

I give devise and bequeath to George H. Elliott of the town and County of Pictou Barrister at law and David McFarlane of the same place Esquires, their heirs and assigns of such survivors a all my messuages lands and tenements wheresoever situated to the use of them the said George H. Elliott and David McFarlane and their heirs of such survivors upon trust, to sell and convey the same in fee simple within the period of two years from the date of my decease or such father time as my said Trustees or the survivors may see fit either in whole or in part and either at public Auction or private sale, to such person or persons  as the said George H. Elliott and David McFarlane or the survivor of them may seem expedient and out of the moneys arising from such Sale or Sales after deducting the charges of my funeral and testamentary expenses and what debts if any, I may owe to divide and to distribute the same as follows.

To my son Henry Webster and his heirs Fifteen Hundred Dollars Canada money in full of any money and interests I may owe him.

To my son William Webster Three Hundred Dollars Canada money in full of any money and interest I may owe him.

To my daughter Mary Two Hundred Dollars Canada money.

To my son John Three hundred dollars Canada money in full of any money and interest I may owe him.

To my daughter Marian fifty dollars Canada money.

The balance of the moneys to be realized from said Sale or Sales of my messuages lands and tenements aforesaid if any to my daughter Mary absolutely.

If the money arising from the Sale or Sales of my messuages lands tenements and hereditaments aforesaid after the payment of my funeral and testamentary expenses and debts if any, owing by me at the time of my death aforesaid and the payment of t legacies beforementioned to my sons Henry and William shall be insufficient to pay the other abovenamed legacies then I order and direct that said last mentioned legacies shall abate in equal proportions to the respective amount so devised.

I give devise and bequeath to my daughter Kate my eight day clock. I give devise and bequeath to my daughter Margaret Beattie one feather bed and bedding. To my daughter Jenet my chest of drawers feather bed and Kitchen utensils and the balance of my household furniture.

If between the date of my decease and the time when  my executors and trustees, or the survivor of them shall sell my messuages lands tenements and hereditaments any time shall elapse I empower my said executors or the survivor of them to lease the same for such term or terms, and for such rent or rents as they or the survivor of them may see fit and the moneys arising from said rents to  expended to be expended in repairing re rendering more valuable the dwelling now erected on the said lands, or in such other manner as my said executors and trustees or the survivor of them see fit.

  I nominate and appoint the said George H. Elliott and David McFarlane or the survivor of them, executors and trustees of this my last Will and testament, and I do hereby revoke all former wills and testaments by me at any time heretofore made.

In witness whereof I have hereto my hand subscribed this sixth day of September in the year of our Lord one thousand eight hundred and eighty eight.

I do hereby certify that the foregoing instrument consisting of three pages, is an exact and literal copy of the last Will and Testament of Janet Webster late of Pictou, in the County of Pictou, Widow, deceased, Testate, which has been duly filed and admitted to Probate in accordance with the practice of the Court.

Given under my hand at Pictou this 24th. day of October A.D. 1890.
