Estate of George W. Underwood late of New Glasgow, Merchant, deceased, Testate

Copy of Will for the Registrar of Deeds

This is the last Will and Testament of George W. Underwood of New Glasgow, in the County of Pictou, Esquire.

  1. I give and bequeath to my beloved wife Margaret during the term of her natural life the house and lands on which I reside with all the furniture and every other thing contained in said house to be by her used and enjoyed as long as she lives together with one cow, the said lands premises and personal property to be by her used and enjoyed during the said term of her natural life.
  2. I give and bequeath to her the my said wife the rent profit and interest accruing on Four thousand Dollars, I order my Executors to pay her said profit yearly the principal to be left in my business should my sons carry on the same, but if not then the sum of Four thousand dollars as aforesaid shall be invested for her by my Executors during the term of her said life. The yearly profits on said sum in no case to be less than six per cent.
  3. I give and bequeath to my daughters Lydia Catherine and Harriet Eight hundred dollars each, to be paid them when my Executors shall see fit.
  4. I give and bequeath to my son John my horse and carriages with the harness, my Stock in the Nova Scotia Steel Company (Limited) and all the Real Estate owned by me at Trenton comprising two lots and I order that he shall within twelve months after my death pay my daughter Lydia Five Hundred Dollars.
  5. All my other estate both real and personal as well as the Real and personal Estate bequeathed herein to my wife for her natural life, I give, devise and bequeath to my sons John and Charles Share and Share alike. It is my desire if they are so minded that my business shall be continued. If any of them shall not be willing to carry on the same he shall give the other full opportunity to buy out his share, the one wishing to remain having a first chance of purchasing. I desire before any of my said sons should sever his connection with the business that my executors be consulted.
  6. I order that my estate and interest hereinbefore bequeathed to my daughter Hattie and my son Charles, shall be under the control of their mother during their minority.
  7. Until my said son Charles arrives at the age of twenty one years my said son John shall be entitled to Two hundred annually for conducting the business.

I nominate Duncan C. Fraser Solicitor, James D. McGregor Merchant, both of New Glasgow and my son John Sole Executors of this my last Will and testament.

In testimony whereof I have hereto Set my hand and Seal at New Glasgow in the County of Pictou, this twenty sixth day in the year of our Lord one Thousand Eight hundred and Eighty six. (Seventy six scratched out and initialed GWU)

I do hereby certify that the foregoing instrument consisting of two pages, is an exact and literal copy of the last Will and Testament of George W. Underwood late of New Glasgow, in the County of Pictou, Merchant, deceased, Testate, which has been duly filed and admitted to Probate in accordance with the practice of the Court.
