County of Pictou. In the County of Pictou, 1881.

In the matter of the estate of William Tupper, late of West River, in the County of Pictou, Farmer, deceased, Testate.

At a Court of Pictou held at the Probate Office, in the town of Pictou, on the 31st.day of August A.D. 1881.

I, Wm. Tupper of the Head of the West river in the County of Pictou, Province of Nova Scotia, being at present in an infirm state of health but of sound & memory & reflecting on my mortality it being appointed for all men once to die do make and ordain this my last Will and Testament.

  1. In commending my Soul to Almighty God who gave it me, I order that my body be decently interred at death & that all my funeral expenses & other lawful debts be duly paid.
  2. I will and bequeath to my grandson who now resides with me, John W. Tupper all the land property I now own and upon which I now reside secured & described to me in a Deed of Indenture bearing date the thirtieth day of March in the year of our Lord one thousand Eight hundred and fifty eight. Reserving nevertheless, of said lands the quantity of Ten acres, lying & Situate on the boundaries of lands now owned by one John Anderson, to my beloved daughter Effie during her natural life & no longer, said lot of land to be held by her as a guarantee for her support & if requires by her for such purpose to be entered upon cultivated & employed for such purpose without any let, molestation or hindrance from any person or persons, whomsoever.

Also all my stock without exception, faring implements , utensils, grain, hay & root crops, household furniture, barn, house, etc. & all & everything else of property now owned by me. I will to & bestow upon my grandson aforesaid, John W. Tupper, conditionally however to my said grandson providing a home & all the necessary comforts & requirements of a home to & for my beloved wife Margaret Tupper during her natural life and providing & paying for all things necessary against her respectful internment at death.

Lastly, I do hereby appoint as my true & lawful Executors for duly fulfilling and carrying into effect the disposition of this my last Will and testament, Mr. Robert Anderson Merchant of West river Station Pictou County, and S. Archibald Esqr. of Watervale West River of said County, giving & granting unto them all such power & Authority as Executors may by law possess or exercise.

In witness whereof I have hereto Set my hand & Seal at West river aforesaid this the fourth day of November in the year of our Lord, One thousand eight hundred & Seventy three. revoking and annulling all other and former wills by me made, ratifying and confirming this as my last Will and Testament.

I do hereby certify that the foregoing instrument consisting of two pages, is an exact and literal copy of the last Will and Testament of William Tupper late of West river, in the County of Pictou, Farmer, deceased, Testate, which has been duly filed and admitted to Probate in accordance with the practice of the Court.
