Last Will and testament of Mary Ann McKay

Certified Copy of Will for Reg of Deeds Pictou

I, Mary Ann McKay of Stellarton in the County of Pictou, Widow, hereby make, publish and declare this my last Will and Testament, hereby at the same time hereby revoking any will or testamentary document by me at any time heretofore made.

I direct my executors hereinafter named, as soon as they conveniently can after my decease, to pay all my just debts, funeral and others expenses attendant upon the settlement of my estate.

I give, devise and bequeath: -

First, To my son David that solid mahogany bureau and bookcase now in the house occupied by me at Stellarton aforesaid.

Second, To my son John, the furniture in the bedroom occupied by me in said house.

Third, To my daughter Elizabeth, the furniture in the bedroom occupied by her said house and the use of said room or another room in said house as may be mutually arranged between her and my daughter Catherine as along as she, my said daughter Elizabeth desires it.

Fourth, To my daughter Christy the furniture in the bedroom occupied by her said house and the use of said room or another room in said house as may be mutually arranged between her and my daughter Catherine as along as she, my said daughter Christy desires it.

Fifth, To my daughter Jessie fifty dollars.

Sixth, To my daughter Jennetta fifty dollars.

Seventh, To my daughter Catherine the house in which I now live at Stellarton and the land connected therewith, known as the Homestead Lot, and all the furniture contained in said house except what has been hereinbefore bequeathed, subject however, to the use of a room or each of them in said house during such time as my daughters Elizabeth and Christy or either of them, require or desire the use of a room therein.

Eighth, To my son Joseph, a building lot forty two feet wide on Stellar Street in said Stellarton, situate between said Stellar Street and the lands owned by my son John.

I direct my executors hereinafter named, as soon as conveniently may be after my decease, to sell and dispose of all my lands unsold at the time of my decease or not hereinbefore devised, to this end, giving my said executors full power and lawful authority to make and execute deeds conveying the same. The moneys derived from the sale of the said land, together with all further moneys and all and singular the balance and residue to my estate whatsoever nature or kind, I give devise and bequeath to my three daughters Elizabet, Catherine, and Christy, or the survivor or survivors of them, share and share alike.

I hereby nominate and appoint my son in law J. Ives Murray and my daughter Catherine A. McKay respectively the executor and executrix of this my last Will and Testament.

IN WITNESS WHEREOF I have hereto my hand and seal subscribed and set this first day of September, A.D. 1905.

I, John D. McLeod, Registrar of said Court do hereby certify that the within or annexed typewritten paper writing is a true and Correct Copy of the last Will and Testament of Mary Ann McKay late of Stellarton in the County of Pictou Widow deceased, which said will was admitted to Probate in said Court at Pictou on the Seventeenth day of October A.D. 1913.
