Copy of Will for the Registrar of Deeds

In the name of God, Amen

I James McKay of Fisher’s Grant, in the County of Pictou and Province of Nova Scotia, Farmer, being of sound mind and unimpaired memory & understanding but considering the uncertainty of human life, do make & publish this my last Will and testament to wit,

1 I will that sum of $500.00 (Five hundred dollars) be paid to my , daughter Eliza, out of my personal property or out of proceeds of same, in yearly installments of $50.00 (Fifty dollars) per annum, until the whole legacy be paid up, including a comfortable home & living, together with all things needed and necessary for same, for and during the terms of her natural life, as along as she remains unmarried.

II. I also and secondly will and devise that my beloved wife Jessie, be provided with a good comfortable home together with all things needful & necessary for enjoying the same, for and during her natural life.

III Thirdly, I will, devise and bequeath to my youngest son Angus Chisholm MacKay, all the real & personal property as specified in original government grant duly recorded, upon which I now reside (after paying abovementioned bequest, to my daughter Eliza.) Situate at Fisher’s Grant, County of Pictou, Province of Nova Scotia, also & and always including all my share of the water privileges on property of the waters of the so called Big Gut in the County & Province afore mentioned.

I do constitute nominate and appoint my beloved wife Jessie executrix, together with Harvey Graham of New Glasgow executor of this my last Will and Testament.

In witness whereof I have hereunto Set my hand Seal and publish and declare this to be my last will and testament in presence of witnesses named below, this the Seventh day of March in the year of our Lord one thousand eight hundred and ninety three.

I James McKay hereby revoke my former appointment of Harvey Graham as executor of this my last Will and Testament, and do hereby nominate and appoint Alexander MacKay my nephew to act in his place together with my wife Jessie as executor and executrix, respectively.

I do hereby certify that the foregoing instrument consisting of two pages, is an exact and literal copy of the last Will and Testament of James McKay late of Fisher’s Grant in the County of Pictou, Farmer, deceased, Testate, which has been duly filed and admitted to Probate in accordance with the practice of the Court.
