Estate of Elizabeth McKay late of Stellarton, Widow, deceased, Testate

Copy of Will for the Registrar of Deeds

I John McDonald do make and publish this as my last Will and Testament, being inform in body and advanced in years and fully conscious that all have to die, desire that my earthly possessions may be disposed of as hereinafter mentioned.

First – I devise and order that my body be decently interred, my Soul I commit to the God who gave it, in hopes of a glorious immortality beyond the grave.

Second – I give devise and bequeath unto my beloved son David R. McKay and daughter Isabella Jane McKay the house and lot no occupied as homestead by the family, also all the personal property of which I may die possessed of whatever kind to be divided in equal parts, Real and personal between the said David R. McKay & Isabella Jane McKay, and I devise and order that if either arty should see fit to dispose of the property, the other party must have the refusal of the same before such can be consummated, and if such sale should take place the proceeds is to be equally divided between the said David R. McKay & Isabella Jane.

Third – I devise and order that while the homestead is held by one or both of the parties my unmarried children will be entitled to occupy it as a home if at any time they require such.

I hereby appoint David R. McKay executor of this my last Will and Testament.

I do hereby certify that the foregoing instrument consisting of one page, is an exact and literal copy of the last Will and Testament of Elizabeth McKay late of Stellarton in the County of Pictou, Widow, deceased, Testate, which has been duly filed and admitted to Probate in accordance with the practice of the Court.

Given under my hand at Pictou this 19th. day of January A.D. 1899.
