Copy of Will for the Registrar of Deeds

In the name of God Amen, I Duncan McKay, Farmer, of Stellarton, in the County of Pictou and Province of Nova Scotia, being mindful of my mortality though at present of perfect mind and memory, Do make and declare this my last Will and Testament – this thirteenth day of December 1882, in manner ad form following, that is to say,

First, I commit my Soul into the hand of Almighty God in the hopes of pardon through the merits of the Lord Jesus Christ, the Saviour of sinners.

Second, I give and bequeath my beloved wife Ann McKay One third of my Real and personal Estate South of the Intercolonial Railroad for her maintenance during her natural life is she should survive me.

Third, I give and bequeath my daughter Catherine Cameron the dwelling house she now occupies and the garden attached thereto, and South to an elm tree on the Bank of the River, thence parallel with a fence on the north side of the garden and also a right of way to Stellarton.

Fourth, I give and bequeath my son Daniel R. McKay the residue of my real and Personal Estate South of the said Intercolonial Railway, Provided that he works the farm judiciously, is dutiful to his mother, remains at home in the evenings only when necessarily called away, and further that he keeps strictly temperate, I further give him the benefit of the lease from the Acadia Coal Co. and the one third already bequeathed to his mother shall his at her death.

Fifth, I give and bequeath my daughter Sarah Bowser the Bill of Sale of her Furniture in my possession.

Sixth, I give and bequeath my son Joseph McKay, One dollar.

Seventh, I give and bequeath my son James D. McKay, One dollar.

Eighth, I give and bequeath my son David R. McKay, the lot of land the Temperance Hall now stands on.

Ninth, I give and bequeath my grandson James Duncan McKay Robert’s son the lot and building on Front Street which his mother now occupies and also the Hay Scale provided that all the produce Sold of m farm be weighed free of charge. I will and direct that his mother have the use of the house during her natural life should she need.

Tenth, I give and bequeath my daughter Harriet J. Wry One Cow to be given when convenient between my decease and five years thereafter.

Eleventh, I give and bequeath my son Isaac, One dollar.

I hereby appoint my son Joseph McKay and James Culton Executors to this my last Will and Testament, revoking and cancelling every other will and Testament by me heretofore made.

I have hereunto Set my hand Seal the day and year first written.

I Duncan McKay, Farmer, Stellarton, do make this my Codicil, hereby confirming my last will made on the 13th. Day of December 1882, and do hereby, give and bequeath to my daughter Harriet J. wry, in addition to my former bequest, the sum of One hundred dollars in the Cooperative Society of Westville.

I also give and bequeath to my son David R. McKay, the sum of One hundred dollars in the Cooperative Society of Westville, in addition to the former bequest.

In witness whereof, I have Signed and Sealed this instrument as my Codicil at Stellarton this 19th. Day of January 1883.

I do hereby certify that the foregoing instrument consisting of two and a half pages, is an exact and literal copy of the last Will & Testament & Codicil of Duncan McKay late of Stellarton in the County of Pictou, Farmer, deceased, Testate, which has been duly filed and admitted to Probate in accordance with the practice of the Court.
