Will of William MacGillivray, deceased
Certified Copy of Will for Reg of Deeds
In the name of God Amen.
I, William MacGillivray of Bailey’s Brook County of Pictou Province of Nova Scotia Canada Farmer do make and declare this to be my last will and testament.
I devise and bequeath to my son Roderick One hundred and twenty acres of the East side of the farm whereon I now reside together with one half of House and barn thereon and also fifty acres of my wood lot on the Mountain.
I also devise and bequeath to my son Hugh and my daughter Ann the remaining portion of my farm on west side with the other half of House and barn and also fifty acres or one half of the Mountain lot. If Ann my daughter will enter the marriage state that then the land devised to her in common with my son Hugh then and in that case will then become all Hugh’s property and if Ann as mentioned enters the marriage state I request that my son Roderick will pay to my daughter Ann sixty dollars currency or its equivalent in other necessaries.
I request and order that my sons Roderick and Hugh shall maintain their Mother and support her during her lifetime in food, raiment and lodging suitable to her and their condition in life, and also that they maintain and support each of my two sisters Mary and Sarah also in food, raiment an lodging as provided for in my Father’s will.
I also hereby order and direct that my beloved wife Mary shall have the sole control and management of my house and the sole control and management of all my personal property during her life time and it is the true intent and meaning of this clause of my will that my said wife shall also hold her right of dower into and upon and out of all the lands herein before devised and bequeathed to my said sons and daughter Heirs and assigns.
I also order and direct that all my legal debts shall be paid out of my personal property and I hereby nominate and appoint Mary my beloved wife, John MacGillivray, Donald’s son, and Donald MacGillivray, Hugh son executors of this my last will and testament.
I also order and request that the approval and consent of the above named executors be obtained before my son Hugh can dispose or transfer to a second party any of the real property devised to him by me.
I do hereby revoke all former wills and testaments by me made and declare this along to be my last will and testament.
In witness whereof I have hereunto my hand and seal subscribed and set this twentieth day of August in the year of our Lord One thousand eight hundred and eighty two.

Signed Sealed pronounced and declared by the testator as and for his last Will and Testament in the presence of us who at his request in his presence and in the presence of each other have hereunto subscribed our names as witnesses.

I John D. McLeod Registrar of said Court do hereby certify that the foregoing paper writing is a true copy of the last Will and Testament of William McGillivray late of Bailey’s Brook in the County of Pictou Farmer deceased which said will was duly admitted to Probate in said Court at Pictou on the 30th. day of April AD 1913.
