I, Angus McGillivray of bailey’s Brook, Pictou County, N.S., Farmer, declare this to be my last Will and Testament,-

I desire that my funeral obsequies shall be performed the manner customary in the Country.

I ordain that my just and legal debts shall be paid out of my personal property herein bequeathed.

I give in trust to my wife Catherine all my real and personal property wherever situate to have and to hold to her, my said beloved wife for the support and maintenance of my children as hereby ordained.

I direct that my sons Donald, John and Duncan, shall use every means within their power as dutiful sons, and each of them respectively, and as soon as can be have all existing encumbrances on my homestead liquidated, but failing individually or collectively to do so within the period of five years, un that event I ordain that my wife, after mature consideration, shall take into her confidence the most trustworthy in her opinion of my said sons to assist her in the direction and management of my estate; and unto him whom she elects I give and bequeath my homestead farm, and all lands wherever situate subject to her reasonable control during the period of her natural life, and also subject to the provisions herein contained.

I ordain that my son James shall receive, or be taught, reading, writing and arithmetic to fit him for such trade as he may choose, and at age eighteen years to be sent to learn such trade as he elect, and to be provided with suitable clothing during the period of his apprenticeship out of the proceeds of the farm so bequeathed.

I ordain that my daughter, Janet, shall also be taught reading, writing an arithmetic in the public schools.

I ordain that, should my beloved daughters Catherine and Mary Jane choose to remain at home with my wife and children, and with such one of my sons as shall have charge or direction of my farm, assisting him in the various duties of house and farm work customary in the country, during the unmarried period of the life of each of them respectively, and in case they or either if them, my said daughters Catherine and Mary jane, become married to receive such marriage portion as my wife shall determine and in accordance with her then circumstances.

I ordain further that, in case of any if my sons Donald and Duncan, should be out of employment abroad, they shall have shelter and raiment in my dwelling house in accordance as my beloved wife shall determine.

I also ordain that my son John shall immediately after my demise shall become associated with my wife in direction and management of my estate.

Lastly, I ordain that all the foregoing orders and decrees shall be duly and faithfully carried out and I hereby appoint Donald McDonald, James’ son, of Ardness and Catherine my wife whom I make, constitute, and ordain guardians of my children and executors of this my last will and testament, ratifying and confirming this and no other to be my last will and testament.

IN TESTIMONY WHEREOF I have hereunto my hand and seal subscribed and set this tenth day of February in the year of our Lord one thousand eight hundred and ninety eight.

McLeod Registrar of said Court do hereby certify that the foregoing paper writing is a true copy of the last Will and Testament of Angus McGillivray late of Bailey’s Brook in the County of Pictou Farmer deceased which said will was duly admitted to Probate in said Court at Pictou on the 15th. day of October 1906.
