Estate of Alexander McGillivray late of Knoydart, Esquire, deceased, Testate

Copy of Will for the Registrar of Deeds

I Alexander McGillivray of Knoydart, in the County of Pictou, Esquire, Do make and publish this my last Will and Testament, in manner and following that is to say,

I give devise and bequeath to my three daughters Catherine (wife of John McGillivray), Blacksmith), Mary and Sarah, all and every my Real Estate of whatsoever description and wheresoever Situate, Share and Share alike, excepting however as hereinafter mentioned, To have and to Hold to them respectively their respective heirs forever.

I give devise and bequeath to my Executors hereinafter mentioned my interest in the lot of land I own jointly with my brother Angus McGillivray (Blacksmith) and Situate at the Hollowell Grant in the County of Antigonish, and now in possession of Donald McGillivray my nephew, in trust however to sell and dispose of the same, and add the proceeds of such Sale to my monies hereinafter mentioned.

I devise and bequeath to my said daughters Catherine, Mary and Sarah all my Stock of cattle, horses, sheep, and farming implements, that is all my personal property, excepting monies, and securities for monies including promissory notes, book account and monies or cash in bank or in any other places, to have hold and take the same Share and Share alike.

I order and direct that all debts due and owing to me shall be collected as soon as possible, that the same be added and put with all monies owned by me deposited in Banks or otherwise, together with the proceeds to be realized from the lads hereinabove devised to my executors hereinafter to be named, in trust to be sold, but of all my monies thus to be realized and made up, I direct my said Executors to be names as aforesaid to invest in the best and safest securities the sum of fifteen hundred dollars, the interest of which I order and direct my executors to pay yearly to my wife Margaret during the term of her natural life.

After her death I devise and bequeath the said sum of fifteen hundred dollars to my said daughter Catherine, one third of the balance or residue of said monies. After paying one third to my said daughter Catherine, I order and direct my executors to invest the balance in the safest and best securities and pay the interest arising therefrom to my daughters Mary and Sarah yearly until they attain the age of twenty five years respectively – or when married, if such event should ever happen.

I nominate and appoint my son Donald D. MacDonald (Merchant) Bailey’s Brook, and my nephew Angus Macgillivray, Barrister at Law Antigonish, Executors of this my last Will and Testament.

In testimony whereof I have hereunto my hand and Seal Subscribed and set this thirteenth day of January 1887.

I do hereby certify that the foregoing instrument consisting of two pages, is an exact and literal copy of the last Will and Testament of Alexander McGillivray late of Knoydart in the County of Pictou, Esquire, deceased, Testate, which has been duly filed and admitted to Probate in accordance with the practice of the Court.

Given under my hand at Pictou this 9th. day of August A.D. 1887.
