Description McGregor, Forbes, McDonald of Merigomish, 1828

Whereas John McGregor of the settlement of Merigomish in the County of Pictou, and Province of Nova Scotia yeoman by Deed of Indenture bearing date the Ninth day of July in the year of Our Lord, one thousand eight hundred and twenty eight, conveyed to Alexander Forbes of said Merigomish, miller, and to John McDonald, Angus' son, of the same place, yeoman, jointly upon certain conditions and considerations, as will fully, and more clearly appear, by reference being had to said Deed of Indenture, a certain lot piece or parcel of land, situated, lying and being in Merigomish aforesaid, beginning at the line of John Rankin, Senior, land on Sutherland River (so called) and runs from thence South eighty eight degrees, thirty minutes east, one hundred and thirty seven rods, and from thence to a small hemlock tree thirteen rods, and from thence south forty eight degrees west, one hundred and fifty three rods, seventeen links, and from thence north eighty one degrees west, twenty five rods, till it comes to said river, and from the several courses of the said river, till it comes to the place of beginning, containing seventy acres by estimation, be the same more or less.  Now this Indenture made the eleventh day of November in the year of our Lord, one thousand eight hundred and thirty nine, between Alexander Forbes aforesaid and the said John McGregor, witnesseth, that for and in consideration of the sum of twenty three pounds, seventeen shillings and six pence, current money of Nova Scotia to him the said

said Alexander Forbes in hand well and truly paid by the said John McGregor, on or before the ensealing and delivery hereof the receipt whereof is hereby acknowledged, hath granted, bargained, aliened, enfeoffed, released, confirmed, and by these presents, doth grant, bargain, sell, alien, enfeoff and confirm unto the said John McGregor his heirs and assigns for ever, all his the said Alexander Forbes moiety or half share of the before described lot, piece, or parcel of land, together with all and singular the improvements, rights, privileges, commodities and appurtenances, to the said moiety or one half of the lot, piece or parcel of land belonging or in anywise appertaining to have and to hold the moiety, or the one half of the said before described lot piece or parcel of land and appurtenances thereunto belonging unto him the said John McGregor, his heirs, and assigns forever, free and clear of and from all claims whatsoever, and also, all the right, title, interest, claims whatsoever, of him the said Alexander Forbes, his heirs, executors, administrators, or assigns, of in and to said moiety, or one half of the before described lot, piece or parcel of land, respectively, and the said Alexander Forbes for himself, his heirs, executors and administrators, doth covenant, promise, grant and agree to and with the said John McGregor his heirs and assigns, that the said moiety, or half of the before described lot, piece or parcel of land, with the appurtenances, unto him the said John McGregor, his heirs, and assigns shall and will warrant, and forever

and forever defend against all lawful claims made against himself, his heirs, executors, or administrators by these presents.  And Margaret the wife of the said Alexander Forbes, doth by these presents, remise, release and forever quits claim to the said John McGregor, all and singular, the right, title and interest, which she now hath, or hereafter may have into or upon the moiety or one half of the said before described lot piece or parcel of land in right of --- or otherwise in witness whereof the aforesaid Alexander Forbes and Margaret the wife of the said Alexander Forbes, have by these presents their hand subscribed and seal set the day and year above written.
