This is the last will and testament of me the undersigned James McDonald of Lower Barney’s River in the County of Pictou, N.S. Shipmaster, made this Thirteenth day of October in the year of Our Lord One thousand nine hundred and twelve.

I hereby revoke all former Wills or other Testamentary dispositions by me at any time heretofore made and declare this only to be and contain my last Will and Testament.

I hereby nominate and appoint Wallace Copeland of Merigomish and Duncan McLean if Bailey’s Brook to be the executors of this my last Will.

I direct that all my just debts and Testamentary expenses to be paid and satisfied by my executors as soon as conveniently may be after my decease.

I give devise and bequeath all my real and personal estate of which I may die possessed in the manner following that is to say:-

To my nephew James Alexander McDonald of Lower Barney’s River, son of John and my sister Catherine McDonald, all my real estate situate at Lower Barney’s River that is to say all my interest and claim in and to the old McDonald farm and homestead together with the buildings stock chattels and all appurtenances to the said farm and homestead belonging.

To my sister Catherine McDonald wife of John McDonald I give and bequeath the sum of Two hundred Dollars ($200.00).

To my sister Mary McDonald of Big Island widow I give and bequeath the sum of One hundred Dollars.

To my brother Angus McDonald I give and bequeath the sum of Two hundred Dollars conditionally only on his giving a legal conveyance, to James Alexander McDonald aforementioned nephew, of all his claim interest and possession to and in the old McDonald farm and homestead. IN the event of my brother Angus failing or refusing to do this (transfer his claim to the property aforementioned) within the term of two years from the date of the probation of this my will then this bequest shall become null and void and I give and bequeath the amount this voided by Angus McDonald ($200.00) to my sister Catherine McDonald in addition to that bequeathed her first written above.

I also name my brother-in-law John McDonald Lower Barney’s River as guardian of James Alexander McDonald aforementioned until he shall become of age.

I give and bequeath to my niece Libbie Ann McDonald Daughter of John and Catherine McDonald the sum of Fifty dollars.

I give and bequeath to my nephew William McDonald my watch and chain wearing apparel and other personal trinkets of a similar nature.

The residue of my estate real and personal then remaining, after settling the foregoing bequests, if any I give and bequeath to my two sisters Mrs. Alex McDonald and Mrs. John McDonald and my niece Libbie Ann McDonald pro rata, or in proportion to the respective amounts first bequeathed them hereinbefore and not including that my brother Angus may forfeit in the pro rata provision, Should my estate not amount to a sum equal to the amount bequeathed hereinbefore specified the difference shall be deducted pro rata from the amounts bequeathed to the legatees,

In the event of my sister Mrs. Alexander McDonald of Big Island predeceasing me I give and bequeath to all her intended interest in this my will to her daughter Catherine McDonald.

Signed Published and declared by the above named James McDonald Testator as and for his last Will and Testament in the presence of us, both present at the same time, who at his request and in his presence and in the presence of each other have hereunto subscribed our names as witnesses.

McLeod Registrar of said Court do hereby certify that the foregoing paper writing is a true copy of the last Will and Testament of James McDonald late of Lower Barney’s River in said County Shipmaster deceased which said will was duly admitted to Probate in said Court at Pictou on the 21st. day of January AD 1913.
