Last Will and Testament of Duncan McDonald (Duncan Michael) of Lismore, N.S.

I Duncan McDonald of Lismore, Pictou County in the Province of Nova Scotia, make this my last Will and Testament.

1st.  I ordain and direct that all my just and legal debts shall be paid out  of my personal property herein bequeathed.

2nd.  I direct and ordain that my wife Mary shall have her comfortable living on the place, and the management of my personal property while she should be capable of the same.

3rd.  When my sons Lauchlin and John Dan shall have between them acquired the property once owned by my brother Hugh, deceased, I ordain that they shall divide both properties, namely my farm, and that now owned by my said deceased brother Hugh, by a straight line running about East and West through the center of both farms combined That Lauchlin shall have that half of the property so divided on which on located my present home that with all its barns houses and outhouses, and that John  Dan shall have the other half of said property so divided, on which on located the houses barns of said deceased brother Hugh.

4th. I ordain and direct that my son Lauchlin shall own and possess those buildings namely my present house together with all its furniture my barns and outhouses which are located on his share of the property, but in the event of my son John Dan wishing to erect any buildings on his lot of the property, I ordain and direct that he be assisted in the erection of these buildings by my son Lauchlin his brother.

5th. I ordain and direct that my beloved sons Lauchlin and John Dan shall own and possess between them each having equal shares of and equal rights to all my livestock namely, my horses, cows, sheep, hens, pigs and all such as make up the stock on my farm or property moreover that they shall own and possess in a similar manner, that is between them all my farming implements, including plows, harrows carts, waggons etc., also all my riding waggons saddles, etc., moreover that they shall assist each other in the farm work and live in peace and harmony as good and God fearing children with each other.

6th. In case that any one of my sons Lauchlin or John Dan should wish to sell or otherwise dispose of his property, shall not do so without first having notified or consulted his brother regarding his intention to sell or so dispose of his property.

7th. I ordain and direct that my daughter Sarah shall have shelter board and raiment on the old homestead as long as she may need it or until such time as she will marry Should she marry then she is to receive as her dower one cow and three or four sheep

8th. To m y sons Lauchlin and John Dan I give and bequeath to lot of woodland on the Mountain the same to be equally divided between them, The same contains fifty acres, more or less, and is situated and bounded as follows, On the North by McRory's lot, on the South by lot of D. D McDonald (Gussett) on West by Corwn land and on the Eaast by land of Wm. McDonald.

Lastly, I ordain and direct that the foregoing orders and bequests shall be duly and faithfully carried out, and I hereby appoint my beloved wife Mary and my beloved son Lauchlin as Executrix and Executor of this my last Will and Testament.

IN WITNESS WHEREOF I have herewith fixed my hand and seal, this first day of June in the year of our Lord nineteen hundred and nine.

McLeod of said Court do hereby certify that the foregoing paper is a true and correct copy of the last Will and Testament of Duncan McDonald (Duncan Michael) late of Lismore  in the County of Pictou, Farmer,  deceased, which said will  was duly admitted to Probate in said Court on the Eleventh day of August AD 1913.
