Estate of Donald McDonald, late of McLellan’s Mountain, Farmer, deceased, Testate

Certified Copy of Will for the Registrar of Deeds

In the name of God, Amen.

I Donald McDonald (tailor’s son) of Marsh McLellan’s Mountain in the County of Pictou and Province of Nova Scotia Farmer, being by the blessing of God of sound mind and memory but taking into consideration he uncertainty of life and the certainty of death Do make and ordain this my last Will and Testament, in manner and form following –

First - I commit my Soul to God hoping for the fairness of all my sins through the merits of and meditation of my Lord and Saviour, Jesus Christ and worldly property I dispose of as follows –

Second - I give and devise to my son Duncan the Shop, and lot which it is Situate on Provost Street in the town of New Glasgow, on condition that he pay to his brother John the sum of One hundred and fifty dollars within one year after the end and determination of the lease of the present tenant E. Morrison, but should my said son Duncan decline to accept the bequest under such conditions within one year after my decease and after the termination of the lease aforesaid that then and in such case I give and devise the said shop and lot to my son John under similar conditions he to pay his brother Duncan one hundred and fifty dollars within the time abovenamed.

But should either or both of my said sons Duncan and John decline to accept the said Shop and Lot under the conditions herein named that then and in such Case I order and direct my Executors to sell to the best possible advantage the said Shop and lot situate in the town of New Glasgow aforesaid, and divide the amount realized from such Sale equally between my said two sons Duncan and John hereinbefore named.

But should either of my said two sons Duncan and John accept the bequest of said Shop and Lot under the conditions hereinbefore named that then and in such case the one of them so accepting said Shop and Lot will pay to my beloved wife Catherine his mother the sum of twelve dollars yearly and every year during the term of her natural life, should my Executor sell said lot, he shall pay said twelve dollars to my wife yearly.

Thirdly – I give and devise to my grandson Angus McDonald the son of my son Daniel McDonald Junior, two thirds of the lot of land I own in the Marsh near the Vale Colliery in the County of Pictou, being lot number Five on a plan of the lands of my late brother John as divided by aw, and the other third of said Lot of land I give and devise to my son Daniel my Executor hereinafter named.

Fourthly – I give and bequeath to my well beloved wife Catherine the sum of Sixty dollars, I also order and direct that the rent of the |Shop and lot in New Glasgow be paid by my Executor to my wife Catherine should any part should any part of the term of the said lease be unexpired at the time of my decease I further give and bequeath to my wife Catherine all my household furniture and bedding should should she choose to remove from and leave my said dwelling house after my death for her own use and to be disposed of by her as she may see right,

But should she live in and remain in the said dwelling house on the farm in the Marsh aforesaid during her lifetime and be cared for and attended to by my sons Daniel will after the death of my wife Catherine his mother have own and possess all and Singular my household furniture bedding of every kind and description.

Fifthly – I give and bequeath to my daughter Christy Margaret wife of Rod McLean twenty dollars.

Sixthly – I give and bequeath to my daughter in law Isabella wife of my son Daniel twenty dollars.

Seventhly – I give and bequeath to my daughter in law Jane wife of my son James William, twenty dollars.

Eighthly – I give and bequeath to Mary wife of my son John, twenty dollars.

All of the above and foregoing bequests I order and direct my Executor to pay to the several legatees within one year after my death out of my personal estate.

Ninthly – I give devise and bequeath to my son Daniel McDonald, Junior, all and singular the remainder and residue of all my personal goods, Chattels effects, debts, credits of all and every kind and description whatever owned by me, or due me at the time of my decease after the payment of all the above bequests to each and all the legatees herein named, and all funeral expenses and the erection of a suitable tombstone to be approved by my Executor.

Tenthly - I nominate ordain and appoint my son Daniel McDonald the residuary legatee herein named as Executor of this my last Will and testament – and thus revoking all other wills by me made and published, pronouncing this and no other as my last Will and Testament.

In testimony whereof I have hereunto Set my hand and Seal & publish and declare this to be my last Will and Testament in the presence of the witnesses named below this twenty eighth day of February one thousand eight hundred and eighty five.

I do hereby certify that the foregoing instrument consisting of three & a quarter pages, is an exact and literal copy of the last Will and Testament of Donald McDonald, late of ‘the Marsh’ McLellan’s Mountain, in the County of Pictou, Farmer, deceased, Testate, which has been duly filed and admitted to Probate in accordance with the practice of the Court.
