Estate of David McDonald, late of Green Hill, Famer, deceased, Testate

Copy of Will for the Registrar of Deeds

In the name of God, Amen.

I David McDonald of the Green Hill and County of Pictou, being of sound mind and memory Do make this my last Will and testament as follows - That is to say,

I give devise and bequeath to my daughter Mary Ann Smith McDonald the sum of twelve dollars,

I also give devise and bequeath to my wife Margaret Isabella McDonald, two cows and Six Sheep, and all my Household furniture Bedding and Household stuff of every description, to her for her use during her natural life only,

and after her death, I give devise and bequeath the aforesaid Two Cows, Six Sheep, and the aforesaid furniture Bedding and Household Stuff to my son John James McDonald,

I also Further give devise and bequeath to my son John James McDonald, all the real Estate, lands, buildings and premises which I own and possess at Green Hill, To Have and To Hold the same to him his heirs and assigns for ever, on the following Conditions.

That is to say, that he fulfill these conditions to his mother, Margaret Isabella McDonald viz. That he give or cause to be given to her each and every year during her natural life Fifteen bushels of potatoes, put into a frost proof cellar at digging time, also one hundred and fifty pounds merchantable oatmeal, also Five hundred pounds merchantable Flour, the meal and Flour to be delivered at her residence on or before the first day of November, each and every year, during her natural life,

Also to winter and Summer in a good and farmer like manner, Two Cows and Six Sheep - after five years from my death, he shall only be required to winter and summer Two Cows and four Sheep

He shall allow his Mother Egress and regress to water, barns, byres, pastures and fields without doing unnecessary damage,

and Further that he allow his Mother one third of the fruit in the Apple orchard each and every year,

and also that the said John James shall give his Mother the use of a suitable Horse and Carriage when required, Seed time and Harvest excepted,

and also that he shall provide at her residence a sufficiency of Coal for one Cooking stove, Summer and winter during her natural life,

Also that the said John James shall provide his mother with a comfortable Kitchen and a comfortable bed room during her natural life, and also he shall provide for a sufficiency of room in a frost proof cellar.

I also after my just debts and funeral expenses are paid and after the aforesaid sums are paid to my daughters, Margaret Jane McDonald and Mary Ann Smith McDonald, further give devise and bequeath to my son John James McDonald on the above and foregoing conditions, all the remainder of my Cattle and Sheep, Horses, Farming Implements, and all Carriages, Sleighs, Sleds, Carts, Waggons, harness and tackling to his John James's benefit and behoof,

and further I nominate and appoint my wife Margaret Isabella McDonald Executrix, and m y cousin Robert T. McCoul Executor, of this my last will and Testament - Hereby annulling and revoking all former wills.

In witness whereof I have hereunto Set my hand and Seal this Eighteenth day of June in the year of our Lord, One Thousand Eight Hundred and Eighty.

I do hereby certify that the foregoing instrument consisting of two pages, is an exact and literal copy of the last Will and Testament of David McDonald, late of Green Hill, in the County of Pictou, Farmer, deceased, Testate, which has been duly filed and admitted to Probate in accordance with the practice of the Court.

Given under my hand at Pictou, this 30th day of August A.D. 1886.
