Will of Daniel McDonald, deceased

Certified Copy for Reg of Deeds

In the name of God Amen.

I Dan McDonald of Barney’s River in the County of Pictou and Province of nova Scotia farmer being of sound and disposing mind and memory do make and publish this my last will and Testament hereby revoking all wills or testamentary dispositions by me at any time heretofore made.

1st. I appoint my beloved wife Mary McDonald, my brother Captain James McDonald and Alexander Robertson all of Barney’s River as my Co. Executors of this my last will and testament directing my said Co. Executors to pay all my just debts and funeral and testamentary expenses as soon as expedient after my decease.

2nd. I give devise and bequeath to my beloved brother Alexander McDonald the western side of my farm on which I live, from a line extending the whole length of the farm and passing between the house and the barn along the roadway to the shore and Comprising fifty acres more or less, the line to take a straight cours except where otherwise specified the bequest being subject to conditions hereinafter specified.

3. I give devise and bequeath to my beloved wife Mary McDonald all my farm now occupied by me except the piece already mentioned in my bequest to my brother Alexander McDonald viz all the land to the east of the line above mentioned between the house and barn.

4. I give devise and bequeath to my beloved wife Mary McDonald my house out houses and barn and together with the barn a strip of land four hundred feet by one hundred and twenty more or less, on the west side of the road between the house and barn above referred to said land extending north of the publick road being the land on which the barn and out houses are situated.

5. I give devise and bequeath to my beloved wife Mary McDonald all my horses cattle and sheep and live stock of what kind soever, also all my house hold furniture of all kinds.

6th. I give devise and bequeath to my beloved mother Catherine McDonald a house and maintenance in my house while she lives.

7th. I give devise and bequeath to my brother Captain James McDonald a room in my house while he wishes to remain there subject to condition hereinafter specified.

8th. I give devise and bequeath to my brother Alexander McDonald a room in my house while he wishes to remain there subject to condition hereinafter specified.

9th. I hereby direct that my wife can if it so seems to her prudent and advantageous sell the house and farm left to her and which case my brothers James and Alexander above mentioned will have no longer claim on the house.

10th. I direct that the piece of land on which the house and out houses are built and which is above mentioned in my bequest to my wife Mary McDonald he attached to the rest of the land left to her in this my will and testament and that the right of way pass at that place through the land to the west of the barn.

11th. I direct that notwithstanding the course of the dividing line the whole of the marsh on the South end of the farm will be the property of my beloved wife Mary McDonald and all the marsh on the north of the barn belong to my brother Alexander McDonald.

In Witness Whereof I have put my hand and seal on this Eighth day of September in the year of our Lord one thousand nine hundred and Six.

I John D. McLeod Registrar of said Court do hereby certify that the foregoing paper writing is a true copy of the last Will and Testament of Daniel McDonald late of barney’s River in said County Farmer deceased which said will was duly admitted to Probate in said Court at Pictou on the 8th day of April 1907.

Witness my hand at Pictou aforesaid this 8th. day of April 1907.
