Estate of Hugh Rose late of New Glasgow, Stonecutter, deceased, Testate

Copy of Will for the Registrar of Deeds

I Hugh Rose of New Glasgow in the County of Pictou and Province of Nova Scotia, Stonecutter, do make this my last Will and testament.

I give devise and bequeath my estate and property, real and personal, as follow that is to say.

I give device and bequeath unto my wife Isabella Rose all the real estate owned by me on West side New Glasgow, bounded as follow on the North by George Street on the east by Albion Street on the south by lands of Peter McPhie on the west by lands of James Cavanaugh subject nevertheless should the needs of my family all minors so require that my executors shall have power and are hereby authorized to sell and dispose of the said property for the maintenance of my said family provided that the said property shall be unsold at the death my said wife Isabella Rose the same shall be divided equally between my family or children.

2nd. The farm owned by me at Fraser's Mountain, bounded as follows, northerly by old road leading over Fraser's Mountain, Easterly by lands of R. McGregor and sons, westerly by and lands of Andrew Anderson and one Chisholm, Southerly by lands of the J. W. Church, shall be held whenever the wants of my wife and family may so require, subject for sale. The proceeds of the sale of said farm to be distributed as follows unless the wants and necessities of my family may so require whose necessities shall be a first charge upon the said farm or proceeds from the sale or otherwise of said farm viz - One Hundred Dollars to my son Alexander Thomas, and One Hundred Dollars to my son John James, the balance from the proceeds said farm to be given to my said wife Isabella Rose for the maintenance of my family as aforesaid.

3rd. - I give device and bequeath unto my wife Isabella Rose all my personal property of any kind or nature whatsoever to be used by her for the maintenance of my family.

I appoint my Uncle David Rose of Trenton in the County aforesaid, Executor and my said wife Isabella Rose is Executrix of this my last Will and testament.

In witness whereof I have signed, sealed, published and declared this instrument as my last Will and testament at New Glasgow aforesaid this twenty ninth day of March in the year of our Lord One thousand Eight hundred and Eighty eight.

The said Hugh Rose at said New Glasgow on said twenty ninth day of March A.D. 1888, signed and sealed this instrument and published and declared the same as and for his last Will, and we at his request and in his presence and the presence of each other have hereunto written our names as subscribing witnesses

I do hereby certify that the foregoing instrument consisting of two pages, is an exact and literal copy of the last Will and Testament of Hugh Rose late of New Glasgow, in the County of Pictou, Stonecutter, deceased, Testate, which has been duly filed and admitted to Probate in accordance with the practice of the Court.

Given under my hand at Pictou this fourth day of August A.D. 1890.
