I certify that the within paper writing marked "Copy" is a true copy of the last Will and testament of John McBain as recorded in the Registry of Deeds for St. Mary's in Book 11, pages 546 and 547.

In Margin - John W. McBain Will registered at 2 P.M. November 1st 1904 on the oath of Angus Cameron and Alexander McBain

In the name of God, Amen.

I John McBain of the East River St. Mary's in the County of Guysboro and Province of Nova Scotia, Farmer, being in delicate bodily health, but of perfect mind and memory, thank be to God, and calling to mind the mortality of my body and knowing that it is appointed for all me once to die, Do make and ordain, this my  last Will and Testament: That is to say - Principally and first of all I give and bequeath my soul unto God and give recommend my body  to the earth in a decent and christian like manner at the discretion of my Executors.

And as to touching such worldly estate as it has pleased God to bless me with in this life, I give  devise and dispose of the same in the following manner and form

I give devise and bequeath unto my beloved brother Thomas McBain, that certain lot, tract or parcel of land situate lying and being , on the Eastern side of the East River St. Mary's in the County of Pictou and Province of Nova Scotia aforesaid and described and identified by a deed from William Jordain to John McBain and dated the fifth day of October in the year of our Lord one thousand eight hundred and seventy five the said lot of land I now occupy. \

Also all other goods chattels and valuable securities which I now own or may own, or possess at the time of my demise, except such part as is by this will and testament otherwise disposed of.

And further that the said Thomas McBain, shall be held liable and responsible for all my liabilities as well as for al burial expenses, &,&.

I give devise and bequeath unto my beloved sister Catherine McBain the sum of thirty dollars current money of Canada to be paid to her by the said Thomas McBain through my executors, also al the benefit arising from an interest right and title in and to the undivided part of the estate of the late John McBain during the time and as long as she shall remain unmarried, and after her marriage or demise he said property shall become the property of my beloved brother Alexander McBain or his heirs, executors, and assigns.

I give devise and bequeath unto my beloved brother Alexander McBain my watch as a token of remembrance.

And I do hereby authorize and empower my executors to pay and discharge the aforementioned legacies according to the true intent and meaning of this testament.
 
And I do hereby utterly dissallow, revoke and dissannull every other former  testament, wills, legacies, bequests, executors by me anywise beforementioned willed or bequeathed, ratifying and confirming this and no other to be my last will and testament. 

And I do hereby appoint and ordain Angus Cameron Esqr., and Mr Alexander McBain, my brother, both of the aforesaid East River St. Mary's and County of Guysboro to be the executors of this my last will and testament.

In witness whereof I have hereunto my hand and seal subscribed and set this eighth day of February in the year of our Lord one thousand eight hundred and seventy six.

Testate, which has been duly filed and admitted to Probate in accordance with the practice of the Court.

Witness my hand at Sherbrooke, this first day of November A.D. 1904.
