I Francis Duke Laurie of New Glasgow in the County of Pictou and Province of Nova Scotia Gentleman make this my last will and testament (sg) FDL written in margin

As I have heretofore made ample provision for my wife I bequeath and devise to Wallace McDonald of Halifax in the County of Halifax Barrister at law and Hedley V. Jamieson of New Glasgow in the County of Pictou and Province aforesaid Barrister at law whom I hereby appoint executors and trustees of this my last Will and testament the whole of my estate and effects of every kind wherever situate to them and the survivors of them his heirs and assigns in trust to sell the same by private or public sale at such time or times as they shall think fit with power to execute the following trusts, namely –

 

First – To pay my just debts

 

Secondly – To pay to my personal friend Murdock McP. Bain for the first three years after my decease three hundred dollars per year, and two hundred and fifty dollars per year thereafter so long as he lives, and also I direct the he have my gold watch and chain and such of my clothing and flowers as he may desire.

 

Thirdly – I direct that after the death of my wife Murdock P McBain have the free and uninterrupted use and occupation of my house and lands in New Glasgow together with the household furniture and effects so long as he live, but should he desire and make his request in writing my executors shall sell the said house and lands and subject the proceeds in some good security and pay over to Murdock P McBain yearly the interest realized therefore in addition to the sums I hereinbefore have been directed to be paid to him. 

Should the said house and lands be not sold in the life time of Murdock P. McBain (sg. FDL above line) then at his death I direct that my house and lands in New Glasgow be sold

 

Fourthly – Should Murdock P. McBain marry and die leaving issue heirs surviving I direct that two hundred and fifty dollars be paid yearly to his widow in her support and that of the issue of Murdock P. McBain so long as she lives unmarried together with the interest on the monies realized from the sale of my house and lands

 

Fifthly – In the event of Murdock P. McBain dying and leaving issue I direct that all the residue of my estate be paid over to his issue without condition **, and if there are more than one issue the residue be divided equally between or among the issue. The time of payment to be made immediately after the death of his widow or should she marry again immediately after her marriage if the youngest child living is then twenty one years of age or is married, but if youngest child is not twenty one of age or married, then so soon as either of these events occur, my executors are hereby empowered unless they deem it unadvisable to advance any time after the death of Murdock P. McBain for the support and education of his issue the interest or any portion of it of the monies that form the residue of my estate (sg. FDL in margin)

 

Sixthly – I bequeath to Wallace MacDonald of Halifax Barrister at law and Hedley V. Jamieson of New Glasgow Barrister at law and one hundred dollars each to be taken by them out of the residue of my estate

 

Seventhly – In the event of my friend Murdock P. McBain dying without issue heir surviving I direct that one third of the residue of my estate be paid over to the Church Wardens of Saint George’s Church New Glasgow for the benefit of the church and (sg. FDL under this line) the other two thirds to be paid over to the trustees of the Aberdeen Hospital New Glasgow for the general benefit of the Hospital

 

I declare it to be my will that in the case of the death, resignation or incapacity of either of my said  executors or substituted executors as hereinafter provided, that the survivor or continuing executor shall immediately in such event happening appoint by writing under his hand and Seal and which writing is to be filed in the Probate Court of Pictou County some fit and suitable person to act with him as substitute executor who shall have the same power and authority in the management of my estate as if he had been directly appointed by me.

 

In Witness Whereof I the said Francis Duke Laurie have to this my last will and testament subscribed my name this sixth day of February in the year of our Lord one thousand nine hundred.

I John D. McLeod Registrar of said Court do hereby certify that the written paper writing is a true copy of the Will of Francis Duke Laurie late of New Glasgow in the County of Pictou Gentleman deceased which said will was duly admitted to Probate in said Court at Pictou on the 20th  day of April 1900. 

 

Given under my hand at Pictou in the County of Pictou this 26th. day of April 1900.
