Typed Deed James Brennan Trustee to D.M. Murphy THIS INDENTURE made the twenty first day of May in the year of Our Lord One Thousand Nine Hundred and seven. Between James Brennan of Pictou in the County of Pictou, Truck man, Trustee of the one Part, and Daniel M. Murphy of Boston in the State of Massachusetts, in the United States of America, Plumber, of the other part, WHEREAS by deed dated the 27th day of March A.D. 1895, and registered in the Registry of Deeds, Pictou in Book III pages 5, 6, and 7, Mary A. Murphy of Pictou aforesaid, widow, conveyed al her real and personal property situate at Pictou aforesaid, including the lands hereinafter described to Edward Doherty of Pictou aforesaid, Victualler, upon trust to sell and convey the same and out of the moneys arising therefrom to pay and discharge all debts and liabilities due by said Mary A. Murphy, including the cost of erecting a tombstone, and the balance to be paid over to said Daniel Murphy. AND WHEREAS said Edward Doherty departed this life intestate, having fully completed said trusts, except as to the sale and conveyance of the lands hereinafter described. AND WHEREAS by Order of the Supreme Court dated the 21st day of May A.D. 1907, and registered in the Registry of Deeds, Pictou in Book 148 page 361, said James Brennan was appointed and constituted trustee in substitution of said Edward Doherty, deceased, and said hereinafter described lands vested in him subject to the trusts of said deed. NOW THIS INDENTURE WITNESSETH, that the said James Brennan as such trustee as aforesaid in consideration of the premises and the sum of one dollar of lawful money of the Dominion of Canada by the said Daniel M. Murphy to the said James Brennan Trustee as aforesaid in hand well and truly paid at or before the ensealing and delivery of these presents, the receipt whereof is hereby acknowledged, Hath granted, bargained, sold, aliened, enfeoffed, released, remised, conveyed and confirmed, and by these presents, Doth grant, bargain, sell, alien, enfeoff, release, remise, convey, and confirm, unto the said Daniel M. Murphy his HEIRS and ASSIGNS, All that certain lot, piece or parcel of land mentioned and described in said Trust deed and situate lying and being in the Town of Pictou in the County of Pictou, bounded and described as follows - Situate on the western side line of Chapel Street, beginning on said Street at the southeast angle of a lot now or formerly owned by Angus McKaracher, and running thence westerly along the rear line of said McKaracher's lot and the lot of land at present owned or occupied by Stephen Veniot one hundred feet, thence southerly at right angles forty four feet, thence eastwardly at right angles one hundred feet to west side of said Chapel Street aforesaid and thence northwardly along the west side of said Chapel Street to the place of beginning, Together with all and singular the houses, outhouses, barns, buildings, ways, water, water courses, easements, privileges and appurtenances to the same belonging or in anywise appertaining and the reversions remainders, rents, issues and profit thereof, and all the estate, right, title, interest, property, claim and demand of the said James Brennan Trustee as aforesaid, of, in to or to the same, or any part thereof TO HAVE AND TO HOLD the said above granted and described land and premises with the appurtenances unto, and to the use of the said Daniel M. Murphy his Heirs and Assigns forever, IN WITNESS WHEREOF, the parties to these presents have hereto set their hands and seals the day and year first above written.
