Form for Mortgages Dated 31 December 1906 Kenneth Beck to James Primrose Trustee MORTGAGE To Secure $ 250 00/100 Davis and Henderson, Manufacturing Stationers, Toronto THIS INDENTURE made the thirty first day of December in the year of Our Lord One Thousand Nine Hundred and six. Between Kenneth Beck of West River, in the County of Pictou, Farmer of the one Part, and James Primrose of the Town and County of Pictou, Trustee under the Will and Testament of John W. Forbes late of Abercrombie in the County of Pictou. of the other part, Witnesseth, that the said Kenneth Beck for and in consideration of the sum of Two hundred and fifty dollars of lawful money of Canada to the said Kenneth Beck in hand well and truly paid by the said James Primrose Trustee aforesaid at or before the sealing and delivery of these presents, the receipt whereof is hereby acknowledged, Hath granted, bargained, sold, aliened, enfeoffed, released, remised, conveyed and confirmed, and by these Presnets, Doth grant, bargain, sell, alien, enfeoff, release, remise, convey and confirm, unto the said James Primrose Trustee as aforesaid his successors their HEIRS and ASSIGNS, ALL that certain lot of land situate lying and being near the head of Pictou Harbor and abutted and bounded as follows, viz. Bounded on the north by lands now or formerly owned by Henry Myers, on the west by lands of John Stewart, on the south by lands of John Henry Beck and on the east by the waters of Pictou Harbor. Containing fifty acres more or less and being the northern half part of all that lot of land sold and conveyed to the said Kenneth Beck by deed from Nicholas beck duly recorded in the Registrar of Deeds Pictou aforesaid Book 43 page 428. and the, buildings, hereditaments, easements, and appurtenances to the same belonging, and the reversions, remainders, rents, and profits thereof, and all the estate, right, title, interest, claim and demand, of the said Kenneth Beck of, in or to the same TO HAVE AND TO HOLD the said above granted and described land and premises with the appurtenances unto, and to the use of said James Primrose Trustee as aforesaid and his successors Heirs and Assigns forever. Provided Always, that if the said Kenneth Beck his Heirs, Executors and Administrators do well and truly pay unto the said James Primrose Trustee as aforesaid and his successors Heirs, Executors and Administrators, or Assigns, the said full sum of Two hundred and fifty dollars of lawful money of Canada in one year from the date hereof and interest for the same after the rate of one dollar per centum per annum payable semi annually on the 30th. day of June and the 31st. day of December in every year as long as the said principal due, or any part thereof shall be permitted to remain unpaid. then these presents shall be void. And the said Kenneth Beck for himself his Heirs, Executors and Administrators doth hereby Covenant with the said James Primrose Trustee as aforesaid his successors Heirs, Executors and Administrators, and Assigns: That he the said Kenneth Beck his Heirs, Executors and Administrators shall and will well and truly pay unto the said James Primrose Trustee as aforesaid his successors Heirs, Executors and Administrators, and Assigns, the said full sum of Two hundred and fifty dollars of lawful money aforesaid, and Interest, for the same at the days and times, after the rate and in the manner mentioned in the foregoing Proviso. And that after breach of the foregoing Proviso it shall be lawful for the said James Primrose Trustee as aforesaid his successors Heirs, Executors and Administrators, and Assigns, peaceably and quietly, to enter into, hold and enjoy the said granted land and premises, without hindrance or disturbance of, from or by any person or persons lawfully claiming the same, or any part thereof. And, also, that the said Kenneth Beck hath a good, sure, perfect and indefeasible estate of inheritance in fee simple in the said land and premises, and hath has a good, sure, perfect and indefeasible estate of inheritance in fee simple in the said land and premises and hath good, right, full power, and lawful authority, to grant and convey the same, in manner and form aforesaid, according to the true intent and meaning hereof. And also that the said Kenneth Beck and his Heirs, the land and premises unto the said James Primrose Trustee as asforesaid his successors Heirs and Assigns, against the lawful claims and demands of all persons, shall and will by these presents WARRANT, and forever defend. And That until payment shall be made of the Principal sum and Interest hereby secured to be paid the said Kenneth Beck his Heirs, Executors and Administrators, will keep without intermission INSURED against Casualties by fire on the building on the said granted premises the sum of Two hundred and fifty dollars of lawful money aforesaid, in some good Fire Insurance Office in PIctou to be selected by and in the name and for the benefit of the said James Primrose Trustee as aforesaid his successors Heirs and Assigns; and will deposit with him or them all Policies and Receipts for renewal premiums of such Insurance. And in default thereof that the said James Primrose Trustee as aforesaid his successors Heirs, Executors and Administrators, and Assigns, shall and may, as required, effect, renew, and continue such Insurance, and charge all payments made for or in respect thereof, with interest after the rate aforesaid, upon the said mortgaged premises.
