Will of Andrew Kitchen

 

Certified Copy of Will for Reg of Deeds at Pictou

 

I, Andrew Kitchen, of New Glasgow in the County of Pictou, Master Mariner do hereby make, publish and declare this to be my last Will and Testament hereby revoking any Wills by me at any time heretofore made.

 

I direct my executors hereinafter named as soon as conveniently may be after my decease to pay all my just debts funeral and the expenses attendant upon the settlement of my estate. 

 

I give, devise and bequeath to those of my sisters who remain unmarried at the time of my decease all my real and personal property of whatsoever nature or kind wheresoever situate, share and share alike.

 

Should my sister Cassie continue to live separate from her husband as she is now doing, it is my will that she be for the purposes of this bequest regarded as unmarried and that she share equally with my other unmarried sisters.

 

In the event of all my sisters being married at the time of my decease, should my said sister Cassie be then living separate from her husband as she is now doing, I give, devise and bequeath to my said sister Cassie one-half of my said real and personal property and the other half of said property I give, devise and bequeath to my other sisters share and share alike.

 

Should all my sisters be married at the time of my decease and my sister Cassie be living with her husband, then it is my will that all my said property be divided equally among my sisters share and share alike.

 

I nominate and appoint my friend George Patterson of said |new Glasgow, barrister, executor of this my last Will and Testament, hereby giving him power and authority if he sees fit, or if it should be necessary as advisable so to do for the purpose of settling my estate, to sell and convey my real estate and execute good and valid deed or deeds to the purchaser or purchasers thereof.

 

In Witness Whereof, I have to this my last Will and Testament subscribed my hand and set my seal this twenty-seventh day of May A.D. 1899.

Signed, sealed, published and declared by the said testator as and for his last Will and Testament in the presence of us both present at the same time, who, at his request,  in his presence and in the presence of each other have hereunto our hands subscribed as witnesses.

I, John D. McLeod, Registrar of said Court do hereby Certify that the annexed paper is a true and Correct copy of the last Will and Testament of Andrew Kitchen, late of New Glasgow in the County of Pictou, Master Mariner, deceased which said will was duly admitted to Probate in said Court at Pictou on the sixteenth day of September A.D. 1913.
