This indenture made this second day of April in the year of our Lord one thousand eight hundred and thirty nine. Between Kenneth McKenzie of the Green Hill in the county of Pictou and province of Nova Scotia, yeoman, of the one part and Donald McKenzie his brother of the place county and province aforesaid, yeoman of the other part. Witnesseth.

That the said Kenneth McKenzie, for and in consideration of the sum of ten shillings current money of the province aforesaid, to him in hand will and truly paid by the said Donald McKenzie at or before the selling and delivery of these presents, the receipt whereof is hereby acknowledged, hath granted, bargained, sold, remised, and forever quited claim, and by these presents doth grant, bargain, sell, remise, and forever quited claim, unto the said Donald McKenzie, his heirs, and assigns.

All that certain tract piece of or parcel of land, situate lying and being on the Green Hill aforesaid (being the southern half of a lot of land owned by Angus McKenzie their father at his decease) abutted and bounded as follows, that is to say, beginning on the old Philadelphia line at the north west angle of One of Ellet’s land, thence said Ellet’s north line south seventy two and one fourth degrees east forty chains to stake and stones, thence south three and three fourth degrees west twenty three chains sixty six links to William Muncy’s north line, thence on the said line south seventy two and one fourth degrees east forty four chains and fifteen links to Alex Fraser’s land thence north six and three fourth degrees east on Fraser’s west line twenty three chains forty links to a stake and stones about four feet to the south east of a small fir marked as a corner, thence north seventy north seventy two and one fourth degrees west sixteen chains fifty links to main road, thence south nine degrees west four chains and twenty five links, thence north sixty nine degrees and one fourth west close past an apple tree in face of bank on same course about eight links on north side of Spring Well to east side of _ four chains, thence south thirteen and three fourth degrees west one chain, thence north seventy two and one fourth degrees west twenty two chains twenty five links to Hemlock corner, thence north three and three fourth degrees east four chains and eighty two links to spruce corner, three north seventy five links to Philadelphia line acres more or less. Together with all and singular the houses, our houses, buildings and improvements, woods, ways, waters, watercourses, rents, houses and profits _ belonging or in any wise appertaining to have and to hold the said lot piece or parcel of land and premises unto the said Donald McKenzie his heirs and assigns forever. Nevertheless the said Kenneth McKenzie still reserving unto himself his heirs and assigns the privilege of an equal share with Donald McKenzie of the fruit which may grow yearly and every year on all the fruit trees at present on either of the lots, during the number of years the said trees may continue to bear, or yield fruit.

And the said Kenneth McKenzie for himself, his heirs, executors, and administrators doth hereby grant, remise, and forever quit claim to the said lot of land and premises, unto the said Donald McKenzie and his heirs and assigns forever. In witness whereof the said Kenneth McKenzie that hereunto his hand and seal subscribed and set the day and year first above and before written.

 

Signed, sealed, and delivered in the presence of us (no names)

 

Received on the day of the date of the foregoing indenture from therein named Donald McKenzie the sum of the shillings being full consideration money therein mentioned.
