Estate of Catherine Baillie late of Pictou, Widow, deceased, Testate

Copy of Will for the Registrar of Deeds This is the last Will and Testament of me Catherine Baillie of Pictou in the County of Pictou, Widow.

I make nominate constitute and appoint my son Alexander C. Baillie sole executor and trustee of this will.

I give devise and bequeath all and singular my real and personal estate of whatever nature and kind and wherever situate unto the said Alexander C. Baillie in trust to sell and convert the same into money hereinafter called the 'trust fund' to pay to Jane Baillie the sum of one hundred and eighty dollars to her sole and separate use and the residue of said trust fund then remaining to divide equally share and share alike between the said Jane Baillie, Clara Sullivan Baillie and Susie M. Baillie daughters of the said Alexander C. Baillie, Arthur C. Baillie and Charles T. Baillie, children of my son George Baillie and the eldest surviving child of my son Kenneth Baillie.

And I also declare that my said trustee and executor may postpone the sale and conversion of my real and personal estate or any part thereof, for so long as he shall in his absolute discretion think fit, and that the rents profits and income to accrue from and after my decease of and from such pass if my estate as shall for the time being remain unsold and unconverted shall after payment thereout of all incidental expenses and outgoings, be paid and applied to the person or persons, and in the manner to whom and by which the said residue of said trust fund would for the time being be payable or applicable under the my will if such sale or conversion had actually been made.

And I also declare that my said Executor and Trustee may let any hereditaments for the time being remaining unsold either from year to year or for any term of years at both rents and subject to such covenants as he shall think fit and annually manage the same in such manner as he shall think fit.

Provided always and it is my will that in case any of my grandchildren above mentioned shall having not at this time of my death attained the age of twenty one years, the share or shares of such respective grandchild in the said trust funds, shall be invested by my said Executor and trustee, for the benefit of such grandchild or grandchildren and the income thereof, paid and applied at the discretion of my said executor and Trustee for the maintenance education and benefit of such respective grandchild or grandchildren.

In witness whereof I the said Catherine Baillie have subscribed my name to this my will this twenty second day of February in the year of our Lord one thousand eight hundred and ninety nine.

Signed published and declared by the said Catherine Baillie as and for her last Will and testament in the presence of us both being present at the same time who in her presence have hereunto have subscribed our names as witnesses, the same having been read over and explained to the said Catherine Baillie who seemed fully to understand the same.
