Estate of David Hudson, late of Westville, Minner, deceased, Testate

Certified Copy of Will for the Registrar of Deeds

I David Hudson of Westville in the County of Pictou and Province of Nova Scotia Miner, make this my last Will and Testament.

I give devise and bequeath my Estate and property real and personal as follows, that is to say,

First - I give and bequeath to Elizabeth my wife the use, rents, and income, of all the Real and personal property owned by me at the time of my death during the term of her natural life without any molestation whatever from any person or persons interested or otherwise, The personal property to be hers absolutely.

Second - I bequeath to Emma my daughter and her heirs and executors "the north half of my house and lot at Westville aforesaid except as hereafter set out, hereby binding my said daughter her heirs and executors therefor to lay my grand daughter Mary Elizabeth Hudson the sum of One Hundred Dollars.

Third -  I bequeath to Mary Ann my daughter her heirs and executors the South half of my house and lot at Westville aforesaid, except hereinbefore set out hereby binding my said daughter her heirs and Executors therefore to pay my grand daughter Mary Elizabeth Hudson the sum of One Hundred Dollars, my daughters aforesaid to inherit the said Estate at the death of my wife and not till then.

Fourth - I bequeath to Mary Elizabeth Hudson my said Grand daughter the top or back end of my lot at Westville fronting Acadia Street, thirty feet front and one hundred feet north and South - "the said Mary Elizabeth Hudson to have possession of the said land at the death of my wife or when she is Eighteen years of age.

Fifth - I also bequeath to my said Grand daughter Mary Elizabeth Hudson a bed and bedding.

Sixth - I hereby order and decree that the said Two hundred Dollars to be paid by both my daughters to my said Grand daughter shall be paid her at the death of my wife if she be Eighteen years of age, if not then the money shall be paid at interest by my executor for the use of my said Grand daughter to be paid to her when she arrives at the said age. Further that all bequests made by me to my said Grand daughter are made to her and her children only,  and in case she die leaving no children. then all the bequests to her both real and personal shall revert to my daughters Mary Ann, Emma, in equal shares.

Seventh - If m y wife see fit at any time after my decease in order that the estate hereby  bequeathed shall realize the largest amount possible, she may with the consent of my executor sell all my real Estate hereby bequeathed and the proceeds shall be apportioned as near as can be in accordance with the true intent of the foregoing bequests.

I appoint James Fraser my Sole Executor of this my  last Will.

In witness whereof I have hereunto Set my hand  and Seal this Eighteenth day of February  A.D. 1875.

Signed  Sealed  published and declared by the said David Hudson as and for his last Will and Testament in the presence of each of us, who at his request and in the presence of each other and have hereunto Subscribed our names as Subscribing witnesses, first having read, and explained the foregoing will to the said Testator, and he acknowledging it as his will thereafter, Eighteenth day of February A.D. 1875.

I do hereby certify that the foregoing instrument consisting of two pages, is an exact and literal copy of the last Will and Testament of David Hudson late of Westville  in the County of Pictou, Miner, deceased, Testate, which has been duly filed and admitted to Probate in accordance with the practice of the Court.

Given under my hand at Pictou, this eighth day of February A.D. 1888.
